Terms of use and purchase

These terms cover the use of thegrainarchive.com and the two packs of darktable presets: the free pack and the full pack. The site is published by Mathieu Benoit LLOBERE EI, trading as The Grain Archive (“we”); see the legal notice. By using the site, downloading the free pack or buying the full pack, you accept these terms.

1. The site

Film pages, preset pages and guides are provided for information. Their facts are sourced, but a source can be wrong or out of date: check the manufacturer’s datasheet before relying on a figure. Before and after images are renders of the presets on digital photos, not film scans. Links to other sites are given for convenience; we do not control those sites.

The content of the site is protected by copyright (see the legal notice).

2. The presets

The presets are darktable styles (.dtstyle files) inspired by films. They are interpretations built from manufacturers’ datasheets, not calibrated emulations (see the method), and they need darktable 5.6 or later. Each preset has a public page that describes what it changes and its limits: read it before you buy.

The presets are covered by the preset license. Each zip contains it as LICENSE.txt.

3. The free pack

The free pack is a free, direct download, with no account and no email address. The preset license applies to it as to the full pack.

4. The full pack

Price and payment

The price is shown on the full pack page in US dollars, taxes included: the amount shown is the amount you pay. The Checkout page may show it converted into your local currency. You pay once, on a Stripe Checkout page.

The full pack is “Sold through Link”: Stripe, through its Link service, acts as merchant of record. Link takes the payment, calculates and collects the VAT or sales tax that applies in your country, and sends you the receipt and the invoice. The payment is also governed by Link’s Sold Through Link Terms.

We remain responsible for the presets themselves: delivering them, making sure they match their description, and answering questions about them.

Delivery

As soon as the payment is confirmed, the download link appears on the confirmation page and is sent by email to the address you gave at checkout. Some payment methods take longer to confirm: the link then arrives by email once the payment goes through.

Each link works for 30 days and 10 downloads. For a new link, enter your purchase email address on your account page.

Updates

The full pack is sold as it is when you download it. Updates are not included: if we publish a newer version, you are not entitled to it, and we promise no future version. This does not affect your statutory rights as a consumer. If you need a new download link for the pack you bought, use your account page.

Refunds and cancellation

Refunds are handled by Link. To ask for one, contact Link support.

  • Under Link’s refund policy, you can ask for a refund within 60 days of the payment if you did not receive the files, if they are significantly not as described or unfit for purpose, if they are damaged or corrupted, or if the payment was not authorized or was taken twice. A change of mind is not covered.
  • If you are a consumer in the European Union or the United Kingdom, Link’s terms also let you cancel your order within 14 days of the date you get access to the files: ask Link support and give “cooling off period” as the reason.

After a refund or a chargeback, your download links stop working.

5. License

In short: you may use the presets on any photo, for personal or commercial work, without credit, and the images you make are yours. You may not share, resell or redistribute the preset files. The full text is on the license page.

6. Liability

The site and the presets are provided as they are. Results depend on your photos, your processing and your version of darktable, which is third-party software. We are not liable for indirect losses, such as lost income or lost work.

Nothing in these terms limits the rights you have as a consumer under the law of your country, in particular the legal guarantee of conformity for digital content.

7. Changes to these terms

We may update these terms. The date at the top shows the last update. A purchase remains governed by the terms in force on the day it was made.

8. Disputes and applicable law

If something goes wrong, write to us first at support@thegrainarchive.com. Disputes about a payment or a refund go to Link support.

These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory consumer rules of the country where you live.
